Use of this website (the “Website”) by you – the end user (the “User(s)”) – constitutes your consent to the following Privacy Policy, which may be amended or updated from time to time and which applies to all services provided, directly or indirectly, on the Website, as determined by Bianca Eilat Restaurant Ltd., Company No. 517238747 (the “Operator” and/or the “Restaurant” and/or the “Company”).
By accessing, browsing, using and/or performing any action of any kind on the Website, you, the User, hereby declare and confirm that you have read, understood and unconditionally agreed to this Privacy Policy; that you are aware of its contents; that you agree that the Operator may use your personal information which comes into its possession in connection with your visit to the Website, the placing of reservations and/or any other action on the Website; and that you shall have no claim and/or demand and/or cause of action against the Operator, the Website, the owners of the Website and/or anyone on their behalf, and you hereby irrevocably waive any such claim in advance, except for claims relating to a breach by the Operator of its obligations under this Privacy Policy.
If you do not agree to the following Privacy Policy, you must refrain from any use of the Website, including registration.
The Terms of Use and all texts on the Website are sometimes drafted in the masculine form for convenience only, but are intended for all genders equally.

1.1 The Restaurant respects the privacy of its customers, including users who access the Website operated and owned by it at bianca-eilat.com, as well as users of the various services offered through it.
1.2 The purpose of the provisions of this Privacy Policy is, inter alia, to describe the manner in which the Restaurant uses information provided to it by users when browsing and using the Website, as well as the manner in which the User uses the content found on, or accessed through, the Website.
1.3 The Restaurant may, from time to time, change the provisions of this Privacy Policy so that they reflect technological, business, legal or regulatory changes. Any such updates will be published in this document, which will appear in its updated form on the Website.
1.4 Use of the Website is subject to the then-current Privacy Policy, and shall constitute your consent to any changes made therein – therefore, we recommend reviewing this Policy from time to time.

2.1 Some of the services provided on the Website require the provision of personal information. For example, when making a reservation at the Restaurant, you may be required to provide details such as full name, payment method details, contact details and email address.
2.2 It is clarified that you are not obligated by law to provide such details, and their provision is subject solely to your free will and consent. However, the provision of certain details is necessary in the sense that, without providing them, you may not be able to perform certain actions via the Website.
2.3 Information provided and/or collected about you in the framework of your engagement with the Restaurant will be stored in the Restaurant’s registered databases and will be used in accordance with the purposes of such databases and as detailed below.
2.4 You undertake that all information you provide and/or update on the Website is true, reliable and accurate; that you are providing such information on your own behalf and for yourself only, and not on behalf of and/or for any third party, except in cases where you have been expressly authorized to do so.
2.5 For the purposes of this document, “Information” or “Personal Information” shall mean data relating to an identified person or to a person who can be identified, as defined in the Protection of Privacy Law, 1981 (the “Protection of Privacy Law”).

3.2 Identifying details: first name and surname, copy of ID card/passport, ID/passport number, vehicle number (if provided for parking purposes), age, gender, ages of your children.
3.3 Contact details: telephone number, email address, physical address.
3.4 Payment details: bank account details, credit card details.
3.5 Information regarding membership in the customer club: information relating to members of the customer club program, booking history, benefits redeemed.
3.6 Information about use of the Website: information about your use of the Website, including the time you accessed the Website, how long you remained on the Website or a certain page, and which actions you performed via the Website.
3.7 Technical information: including information regarding the Internet connection (such as IP address and Internet service provider), information about the device you use to access the Website (for example, device type and operating system installed on it).
3.8 Additional information: any additional information about you or about third parties that you may provide us during your use of the Website or otherwise.

4. Methods of Collecting Information
4.1 We use various methods to collect personal information from and about you, including the following:

We collect such information through logs, cookies and similar technologies. In addition, security cameras are installed at the Restaurant, which may collect images of you during your stay at the Restaurant.
4.4 Public information and information received from third parties: we may receive personal information, such as identifying details, contact details, booking details, payment method details, information about your stay in the hotel and information about customer club membership, from third parties such as travel agencies, online booking websites, credit card companies, insurance companies and various service providers. In addition, we may receive technical information and information about your use of the Website from analytics providers and advertising partners.

5. Purposes of Use of the Information
5.1 The Restaurant may collect and use the information collected, including information received as a result of engagement via external providers (such as, but not limited to, ontopo), in order to improve, enhance or modify the Website (including modifying the Website as presented to the User), the services and content offered on the Website, including those offered by the Restaurant, anyone on its behalf and third parties with whom the network has a business cooperation, as well as in order to optimize and manage the relationship with users.
5.2 In addition, and in accordance with the purposes of the database, the Restaurant may use the data and information for marketing and commercial purposes (including targeted and personalized marketing to users), for statistical purposes, and may provide statistical information to third parties, including advertisers, in accordance with this Privacy Policy.
5.3 The Restaurant may also use the information for the purposes of managing and optimizing the relationship with users, contacting users where necessary; maintaining the Website and/or systems; improving the content and services that the Restaurant offers on the Website to users on both an individual and general basis.
5.4 Without derogating from the above, subject to the User providing the Restaurant with his or her contact details and consent to receive direct marketing, the Restaurant may send the User, from time to time, by email and/or text messages and/or other communication means provided by the User, information regarding its services as well as marketing and advertising information of the Restaurant, including newsletters, satisfaction surveys and analysis of feedback for the purpose of improving hospitality and service, and information regarding the management of the customer club, including accumulation of points, redemption of benefits and updates regarding the account status. The User may withdraw his or her consent at any time and cease receiving such information by contacting us via the Website, or by using an “unsubscribe” link which may appear at the bottom of the message sent.
5.5 Cookies
5.5.1 The User is hereby informed that the Website uses various online digital identifiers, which will generally be referred to as “cookies” (“Cookies”). Cookies are used for the ongoing and proper operation of the Website and the services, for data security purposes, as well as to collect statistical data regarding the use of the Website and its services, for verification of details, and to improve the browsing and usage experience, by adapting the Website to personal preferences, simplifying navigation, profiling products and tailoring offers, including during browsing on other websites, all for marketing, statistical, research and commercial purposes, and of course for information security purposes.

5.5.4 Without derogating from the above and from the provisions of this Privacy Policy, the Restaurant may transfer non-identifying information to third-party advertising systems, including Google and Facebook, as detailed in this Policy, in order to display to the User content and advertisements that may be of interest to him or her and/or suited to his or her preferences.
5.5.5 A User who does not wish cookies to be collected on his or her computer may prevent this by changing the browser settings on his or her computer. To do so, the User should consult the browser’s help file. Disabling cookies may result in some of the services on the Website not being available or their quality being impaired. Notwithstanding the above, cookies that are essential and necessary for the operation and management of the Website cannot be disabled.

6. Disclosure of Information to Third Parties
6.1 We may transfer personal information to third parties in the following cases:
6.2 To subsidiaries, parent companies, affiliated companies and/or other entities related to the hotel in connection with the provision of the services;
6.3 To contractors or service providers on our behalf, for the purpose of providing and improving the services (for example, cloud service providers, payment processing providers, software companies, travel agents, security service providers, analytics providers, mailing and targeted advertising providers, etc.);
6.4 To our professional advisors (such as attorneys, accountants), to the extent required for the provision of their services;
6.5 If we organize our activities within another entity, including by way of merger, sale of activities, etc., provided that the entity with which we merge and/or to which our activities (in whole or in part) are transferred, assumes the provisions of this Privacy Policy;
6.6 To purchasers or potential purchasers of the Company or parts thereof, in connection with the examination of an acquisition or investment in the Company;
6.7 In the event of a legal dispute between you (and/or anyone on your behalf) and the Company (and/or anyone on its behalf), to the extent required in connection with the handling of such dispute;
6.8 For the purpose of sending and displaying marketing and advertising content, including personalized advertisements;
6.9 To additional parties, at your request and/or with your consent and approval;
6.10 In accordance with the requirements of any law and/or competent authority, as well as for the purpose of conducting legal proceedings;
6.11 Within the framework of business collaborations with companies that are commercially affiliated with the Restaurant, including companies engaged in table reservations at restaurants such as ontopo;
6.12 In the event of a breach of this Privacy Policy or the Terms of Use and/or in the event that actions contrary to the Terms of Use, including this Privacy Policy, and/or contrary to the provisions of any law, are carried out via or in connection with the Website;
6.13 When navigating to other websites via external links, including those of Facebook, YouTube and similar services appearing on the Website – information about the use of the link will be transferred to such websites. This Privacy Policy does not cover the information collection procedures or policies of such websites and services and/or any third party, and any use you make of such links and/or services is at your sole responsibility.
6.14 For the purpose of completing a request and/or inquiry and/or providing a service and/or transferring a payment on your behalf. The Restaurant uses external payment processing services, and for such purpose, and in order to carry out payments and charges, your payment details will be used as well.
6.15 Transfer of personal information to a third country (outside Israel and the European Union): the Restaurant may transfer information for storage or processing outside the borders of the State of Israel, including to European countries and the United States.

7. Information Security
7.1 The Restaurant does its utmost to protect the confidentiality of the information, by taking accepted precautions and using security technologies. The Restaurant invests resources and takes measures to prevent intrusion into the Website and to prevent possible harm to privacy; however, it cannot completely prevent disruptions.
7.2 The communication between the User’s or visitor’s computer and the Restaurant’s computers is secured using standard encryption methods, in accordance with accepted standards.
7.3 All credit card usage and processing (clearing) from the Website is carried out in an encrypted and secure manner via an external credit card processing company, which uses advanced encryption technologies and mechanisms that comply with international standards (the “Clearing”). The User is aware that the Restaurant shall not be liable for any damage and/or loss, direct or indirect, of any kind, caused as a result of the Clearing.
7.4 It is hereby clarified that we do not collect or store credit card data or payment method information (except for the last four digits for verification purposes). All payment method details are stored by payment and clearing companies in accordance with your direct engagement with them (a booking window may open on our Website or booking portal, but it leads to their service; you are requested to read their terms of service and privacy policy).

8. Limitation of Liability
8.1 To the extent permitted by law and to the maximum extent so permitted, in no event shall the Restaurant and entities related to it, including partners, officers, directors, employees, shareholders, agents, subcontractors and suppliers, be liable to you and/or any other entity, whether under contract, tort or any other cause of action, for any direct, indirect, secondary and/or consequential damages, including, without limitation, loss of data, special or punitive damages, arising from or in any way connected to the Website or membership in the customer club and/or to any malfunction, inaccuracy, omission, defect, security breach and/or any failure in the Website or in the information, even if the Restaurant was aware of the possibility of such damages.
8.2 Exclusive jurisdiction over any dispute and/or claim arising in connection with this Policy shall be vested in the competent courts in Tel Aviv–Jaffa.

9.1 Under the Protection of Privacy Law, 1981, you, the User, or anyone on your behalf, are entitled to review information about you held in the Restaurant’s databases and to request that the Restaurant correct such information if it is not correct, complete or accurate. To exercise the rights granted to you under the Protection of Privacy Law, you may contact us in writing using the contact details below. You may review information held about you in the Company’s databases, subject to the provisions of the Protection of Privacy Regulations (Conditions for Review of Information and Procedures for Appeal on Refusal to a Request for Review), 1981. In your request, you must specify all details required under the Review Regulations, including the reasons for the review request and the type of information you wish to review. If you find that information held in the Company’s databases is not correct, complete, clear or updated, you may request that the information about you be corrected or deleted.
